Beware the Rental Scam

This is for real so take notice.  If it pertains to you - take action.

In San Diego, CA there is a crew of scam artists who have come up with a pretty quick way to make money.  They have someone with MLS access search for vacant homes that are accessed by combo lock-boxes.  

They post the home on Craigslist or other home rental sites and meet the 'mark' at the listed home.  They take the first month, last month and security deposit from the people and are never heard from again.

Their cover has been blown in San Diego so it is thought they are moving north.  I wouldn't be surprised if this becomes common across the country.

Currently in the SOCAL MLS there are 3.359 listings using combo lock-boxes.  Just think of the potential liability.

If this is you.  Take your combo out of the MLS and Get an electronic lock-box.

Jury Duty - Does self-employed mean anything anymore

I just received a summons for Jury Duty.  Now I would love to do my civic duty but I have a newborn and I am the sole  provider for my family.  As we all know in this Real Estate market any time off can mean lost business.

I submitted I was self employed and any time away from work would create financial hardship.  I heard lately this reason is not enough to be excused.

They now have call in Jurors.  For those of you who have not heard of this it is: You call in the day before you are scheduled and they tell you to come in or not.  You have to do this for a week, and if they do not need you the entire week, you are done.  

I would have this as I could not make appointments, would have to cancel at the last minute.  

Well, it would be nice to be excused, but this government needs us to survive.

My Open House Today - Deep Thoughts by Adam Brett

As I sit in my open house with Verizon Laptop Connect powering my blog - I think is it going to be a good day, and is there a potential lead I let go.

Well - they day will bring what it may, my goal is to capitalize on every person stepping through the door.  

So, I opened the door at 11:00AM and it is now 2:30.  I have had 23 people so far, and 18 of them are neighbors.  I don't look at these people as a waste of time, but a great chance for them to interview me.  They see my presentation and presence.  I have a multitude of signs out, boards in the house displaying market information and trends, mortgage rates, bank repos, default notices and shorts sales in the area.  

We talk about the market, what is happening on the street (I have 3 listings within 10 homes on the block), and what I think the future will bring.  I know these people will not be buying this home, but they might have a friend who needs a Realtor, they might be thinking of selling, or just might want to talk.  Any of these is fine with me.

The 5 people not from the neighborhood have been a mixed bag.  1 of them was in quickly - liked the home and ran out telling me he would bring his wife back.  2 of them were looking for a SFR under $300,000 - which does not exist in this city.  The other 2 were just browsing - from Georgia and will be moving in a year or so.

Is it a good day?  I have not taken any concrete leads, but I have made a showing in the neighborhood.  I am hard working and doing more than most Realtors.  

I consider this productive although I might not have sold the home I have open or made appointments for later in the week.  

Just my thought for the day.

Do You Have a Market Conditions Disclosure

My brother in law is an E&O lawyer and he told me to start using a Market Conditions and Pricing disclosure.  I looked at the C.A.R. form and it is for the buyer, but I am looking for the seller.  

To protect ourselves in an unstable market, we tell our sellers we will try to get them top dollar, but the market can change quickly and that is out of our control.  Also, about pricing being set by them with our guidance.  

My brother-in-law is defending 2 cases where sellers realized less than the were 'told' by their Realtor at the start of the listing, and now want compensation.

I was wondering if anyone is using a disclosure (not that it means much in front of a judge), but something to mitigate a potential problem.

Fullerton High School - Information and Facts

  • Fullerton High School is a high school located in Fullerton, California, United States.
  • History: In 1893 a special election was held to create Fullerton Union High School. The school's first classroom, a rented room on the second floor of the Fullerton Elementary School building, was adequate to house the eight pupils, which constituted the first year's enrollment and the 32 books which made up the library. The high school was Orange County's first.
  • In 1908, FUHS's enrollment was increasing at the rate of 18 percent a year. To accommodate the growth, the school was moved to new quarters on West Commonwealth Avenue, an area now known as Amerige Park.
  • School enrollment continued to grow and within two years a new polytechnic building was built to ease the overcrowding. But on November 17, 1910, the day before it could be occupied, the older FUHS building burned to the ground. FUHS was housed in the polytechnic building and four tents that year. After the fire, the school's trustees debated the best location for rebuilding. The district owned the ground on which the polytechnic building stood, but the campus was small, and school work was disrupted by the numerous Santa Fe trains that roared by each day.
  • In 1911, the present site was purchased one block east of Harbor Boulevard. A walnut orchard was removed prior to building, and the former site was sold to the City of Fullerton for use as a park.
  • The school's facilities have changed over the years to meet educational and community needs. Plummer Auditorium's original ironwork, which was made by students on the campus, was kept when Plummer was refurbished and remodeled to meet earthquake standards in 1973. Since then the stadium, locker rooms, and the agriculture complex have been rebuilt. The latest replacement was the swimming pool. Renovations of Plummer Auditorium were recently completed, and the Charles Kassler fresco APastoral California@ was uncovered and completely restored in 1997.
  • The original buildings no longer stand, but the pride which built the school is reflected in the continuation of the architectural styles of the original design. The affection and spirit which accompanied FUHS's rapid growth and emphasis on excellence are reflected in the continuing concern for excellence in FUHS's programs and image. The lasting and cherished legacies span over a century.

If Grandma Had Listened to These Folkes - My Inheritance Would Be Gone

For the Past 60 years, economists, Wall Street Analysts, and other supposed financial experts have predicted the end of Real Estate Appreciation.  Take a quick trip through their far-off-the-mark forecast from years gone by:

Two RE/MAX Associates recount stories of heroism, action in times of crisis

Adam Brett is skilled at putting out fires in business deals. But it was his training as a reserve sheriff’s deputy that helped him quell a real-life blaze.

Brett, a Sales Associate with RE/MAX North Orange County in Fullerton, Calif., saw smoke billowing up the side of a house. He drove to the scene and his deputy instincts took over.

“The first thing I did was clear people from nearby houses,” says Brett, who joined RE/MAX last year. “A bunch of people were standing around, and I made use of them and tasked them.”

With the help of some neighbors, Brett got the homeowner out of his house and evacuated an elderly neighbor from hers.

“He was really frantic,” Brett says of the homeowner. “I grabbed hoses from the neighbors and we started hosing down the houses. We had the fire put out before it got out of control, but the garage was burnt to a crisp.”

Brett’s quick thinking helped save lives and homes. However, he cautions agents who come across similar situations to be careful.

“Don’t try to be a hero,” says Brett, noting that as a reservist, he's trained in emergency response. “Try to be as helpful as you can without putting yourself or anyone else at risk.”

Brett isn’t the only RE/MAX agent who has faced a life-or-death predicament this year.

On a rainy afternoon in March, RE/MAX Hall of Famer Frank Tierney (CRS) was taking a different route to one of his listings in Lake Zurich, Ill. The Broker Associate with RE/MAX Unlimited Northwest saw smoke and flames shooting from the eaves of a house, so he stopped to help.

“Right away, I called 911,” says Tierney, a 31-year real estate veteran who’s been with RE/MAX since 1994.

He heard someone say that an elderly man was inside the house.

“The door was unlocked, so another fellow and I ran in and brought him out,” Tierney says. “A neighbor said that two other people lived in the house, so we ran inside and swept the house, but didn’t find anyone else. When we ran out again, we heard a loud explosion.”

When the fire department arrived, Tierney left for a showing. At the meeting, his client told him he smelled like smoke, and Tierney was proud.

“I wore the smoke like a badge,” he says. “I believe I was there for a reason. I have no doubt that someone else was driving my car that day.”

Handling emergency situations

Brett and Tierney offered these tips should agents encounter situations similar to what they faced:

  • Call 911 immediately – “That’s the first thing you do,” Brett says.
  • Be a good neighbor and report incidents – “We’re out in these neighborhoods every day,” Tierney says. “Don’t be afraid to look around and call things in.”
  • Use your best judgment – “Put human life above property and pets,” Tierney says. “Keep your wits about you.”
  • Get training – Brett encourages agents to enroll in community emergency response training (CERT) classes offered by many law enforcement departments.
  • Don’t rush to the rescue – “Unless you know you can help the situation, stay out of it,” Brett advises. “Protect yourself, protect other people, but don’t try to be a hero.”

How to Stay Out of Legal Trouble

My brother-in-law is an E&O lawyer so I frequently ask him why people get sued, and how to prevent it.  The most common setup that ends in litigation is an agent who has double-ended a transaction, and 1 party feels the agent did not act with due diligence.  He says this accounts for about 90% of the suits he sees.  About 90% of these lawsuits are about non-disclosure.

This does not mean if you are not double-ending a deal you have nothing to worry about.  Quite the contrary but follow these simple rules and you will steer clear of most trouble.

1.  Disclose everything you know.  If it kills a deal - so be it.  

2.  When disclosing known facts and defects do not use descriptive words (SMALL CRACK, MINOR DAMAGE, etc.).  You are not a contractor - let the buyer decide for themselves if it is minor.

3.  Keep your mouth shut.  Do not tell the opposing side what you think your clients are willing to do.

4.  Keep lines of communication open.  Most problems can be resolved with a simple phone call and discussion.

 

These are rules to live by in this business especially with the increase in litigation. 

Not only will this keep you out of trouble, but it will give you a more ethical and loyal presentation to your clients.

Does your car make a difference?

Realtors are supposed to be these super rich people that drive fancy cars, wear nice clothes, and go out to expensive dinners – right?  Well not exactly.  Since 95% of the business is done by 5% of the people the majority of Realtors do not have lavish cars – but does it truly make a difference.

What about classic cars, or American Muscle?  I have taken clients in 3 cars, and I definitely noticed a difference in 2 of the 3.  The first was a 1994 Mustang GT 5.0.  Good old fashioned muscle car.  Clients loved this one.  It was a $20,000 vehicle, but what is lacked in flash, it made up for in attitude.

Second was a 1997 Jeep Grand Cherokee.  This was the nothing special car and I never received a comment – good nor bad.  It did the job.

Third is a 2003 E320 Mercedes Sport sedan.  Not we get the flash and perception of wealth.  Clients always comment on it and they love being driven around. 

Now the overriding question:  Does it make a difference on business?

I would say NO.  If you have a clean average car you will not be at a loss.  Sure there are some people that are impressed with cars, but your knowledge and confidence can definitely outweigh what you drive.  With that being said, if you show up in a Mercedes that has 2 week old fast food in the back seat, I don’t think it matters what you are diving. 

In certain areas of the U.S. and depending on your cliental I am sure there are exceptions some that demand luxury. 

You also have to appear successful – so what is the balance?

The Fed - Lowering the Discount Rate and what it means

This morning, the Fed lowered their Discount Rate by .50%, taking it from 6.25% down to 5.75%.  The Discount Rate is the rate at which the Fed lends money directly to commercial banks, credit unions and savings and loans including large lenders like Countrywide and Bank of America.  It is different than the Fed Funds Rate, which is the rate at which banks lend money to other banks.  The Discount rate is usually held 1% above the Fed Funds Rate, which makes the Fed a last resort for lending institutions to borrow from - they would generally of course rather borrow from other banks at a lower rate - but with the current liquidity crisis making that difficult, this move will help provide some liquidity at more desirable rates in the short term.  

More importantly, the Fed is extending the borrowing period from overnight to 30 days, which could allow some lenders to use the discount window for loan fundings prior to sale in the secondary market.  The 30 day extension allows time for the credit markets to settle a bit so that buyers of mortgage-backed securities can come back into the market.  The next 30 days are important and this Fed move does help some large financial institutions better weather the storm.  Additionally, most analysts are forecasting a high likelihood that the Fed will cut the Fed Funds rate on or even before the next Fed Meeting on Sept 18th.

Realtor.com - Featured - Showcased - Is is worth paying for exposure

Realtor.com is the #1 Real Estate Website in the United States.  They had over 9 million unique users in the last quarter  and claim to capture 84% of buyers hitting the internet.  

They offer 3 different ways to advertise your listing.  

The standard listing is given to everyone and contains 1 picture of the home, you cannot customize the text, and the listing agent is not given the right-hand sidebar.

Then there is the Showcase Listings.  This package offers substantial benefits to the freebie.  You get up to 25 pictures, the option to add a virtual tour, agent picture and contact information on the sidebar, ability to change text from the standard (3 bed, 2 bath ....), and when the property is in the overall list, you can add scrolling text to the top and it is highlighted with the showcase banner.  You pay for this based upon your listing volume.

The highest level is the featured listing and agent.  This puts your listing in one the main search page and according to Realtor.com give you up to 500% more visibility.  Please correct me if I am wrong but this is the only difference between featured and showcase.

It is a definite benefit to both the agent and the seller for properties to be showcased.  More pictures, agent information, virtual tour, and more.  

Is it worth the money (sometimes over $1000) for each spot per zip code to be featured.  

I am currently showcased on Realtor.com and have seriously been thinking about getting featured.  I spoke with an account rep who of course pitched it as the best thing since sliced bread.

I also spoke with 3 agents who are featured in the area and they have not seen a discernible difference with being featured over showcased.  Now it might be so golden they do not want to have more competition,  but they rarely if ever sell a home or get a client strictly off Realtor.com.

I would love to hear from agents with Realtor.com experience.  We are talking high visibility - but is is worth the money?

Local Agent Puts Out House Fire; 'All in a day's work' - How to get noticed

The article below details a house fire that I helped extinguish not too long ago.  

Sure this is a shameless self-promotion plug but I hope you can also take something else away from it.  I have a copywriter who I enlisted to write articles about me on a routine basis.  Now this one is extraordinary, but I plan on having her write something once a month.

This is another method of branding without necessarily touting real estate.  I have found that people might not want to read about Real Estate as it is getting shoved down their throats at the moment, but they would be happy to read how you helped open a dog park, or an experience with community service.

Find a writer for your local paper (they are the ones with the connections to get published) and have them write something about you.  It doesn't have to be groundbreaking - just interesting.

How Big is Your Farm - is Bigger Better?

I started with a farm of 250 homes.  I slowly increased and now deliver flyers to 5000 homes about every 3 weeks to a month. 

At what point does the cost outweigh the return.

I think I have a very unique flyer and I plan on increasing my farm as income dictates.  I have the flyer die cut around the house with a door hanger hole in the fireplace.

I can print these delivered to my home for 6.4 cents, and the cut costs 1.5 cents per page.  I have them hand delivered for about 11 cents.  So my total to deliver is about 19 cents per door.  I think of it as if I can capture 1 transaction due to my flier alone, it will pay for the year of advertising.

Branding yourself is huge.  

I do not always get calls from the flyer - but I compare it to the Pennysaver - coupon books, etc that get delivered to your home on a routine basis.  You might not need or want it this week, next week, or even next month. But the day you do, you are expecting it to be there.

Bringing your Personal Life Into Your Business - Bonding with your Clients

Realtors all too often are strictly business and forget the client is human with similar life experiences.  

I used to keep my personal life separate and never share what is happening with potential and current clients.  The past six months I changed this.  My wife was pregnant and I started telling people I was expecting my first child.  WOW! What a response.  I had people engage me now that I was more human.  

We got talking about children, what to expect, I asked for advice, and it became a topic in which they were the 'expert' and allowed us to bond before we even got into talking about real estate.

I seem to mention her all the time.  Not only am I a proud father but I have something in common with people that is universal.  This is more than a hobby.  Having a child is life changing and allowing people some insight is a real bonding experience.

Now that I have seen the power of being personal I feel it is a must when dealing with people's homes and lives.  

I even thought on my next advertising piece introducing her as my new assistant.

Market Update for Fullerton CA - 92831 Zip - Charts Facts and Trends

As I mentioned in my Market Update for Fullerton, CA We have a very unique demographic that consists of multiple ethnicity, religion, and income levels as well as homes built in the early 1900's to new construction.

Since Fullerton's demographics are so diverse, the housing market cannot be categorized by the city as a whole.  This blog will break down one zip code within Fullerton, CA - specifically 92831.

The 92831 zip code is home to Troy High, ranked #19 in the nation and ranked #1 for computer science, home to Cal State Fullerton, Fullerton College, Western Law School, Fullerton High School, Acacia Elementary, Ladera Vista Junior High and the list goes on.

Homes in this area range from 6,000 square foot new construction to 1920's craftsman bungalows.  It is considered one of the most desirable areas of Fullerton and if you compare this market analysis to that of the entire city of Fullerton, you will see a very different Real Estate Market.

Fullerton MArket Analysis

The chart above is for Single Family Detached Homes in the 92831 Zip code showing all Active - Pending - Sold listings for the past 14 months.  In comparison to all of Fullerton where we have similar numbers as last year, the 92831 has barely seen an increase in supply with only slightly less demand.  Does this defy the media reports of Doom and Gloom?  I would say yes.  While home prices in surround areas have declined steadily, homes in 92831 have held their value if not increased on the most desirable of homes. 

If the cyclical trend holds true, 92831 will be in for a frenzy come the beginning of next year.  As always we will see a decrease in inventory leading up to the holidays bottoming out in February.  We will see the standard influx of buyers during February as well - so get ready.

What about condos and townhouses?

92831 Market analysis

This chart covers all Condos and Townhouses in the 92831 zip for the last 14 months of Active - Pending - Sold listings.  This looks fairly similar to the overall pictures for Fullerton Single Family Homes where we have similar inventory levels as last year, only we have had a steep decline in demand.  Buyers, especially sub-prime have disappeared for this market.  Even thought 92831 is very desirable, condos are the first to lose value and the last to gain.

So, the overall picture of 92831 is actually pretty rosy.  The Single Family Home market is alive and well, even outperforming the Orange County Market and definitely the national market.  The condo market is holding in there, but we can expect to see some losses before it gets better.

Market Update for Fullerton CA - Orange County - August 14-2007 - Charts and Trends

in the real estate market.  We have a very unique demographic that consists of multiple ethnicity, religion, and income levels as well as homes built in the early 1900's to new construction.

Since Fullerton's demographics are so diverse, the housing market cannot be categorized by the city as a whole.  This blog will attempt to do so, however my next postings will be zip codes within Fullerton, which will have drastically different trends than are posted below.

When the media reports astounding numbers of dropping home sales, increasing inventory, and plummeting prices, we have to look at what figures they are trying to represent.  Well, here are the RAW figures for the city of Fullerton.

This chart is of Active - Pending - Sold inventory of Detached Single Family Homes.  As you can see the market is cyclical with inventory peaking in August.  This is what we will deem as Supply.  The demand is calculated by the Pending Sales (this is how many homes went into escrow).  So, give laws of simple economics we are at a time of high supply and low demand - hence a buyer's market.  While inventory levels are comparable to this time last year, our sales are down slightly. 

This chart is of Active - Pending - Sold inventory of Attached Condos and Townhouses.  The same cycle exists as Single Family Homes with inventory levels (supply) being very comparable to last year, but the number of buyers (demand) has dropped sharply.  The demise of sub-prime lending has hit the condo market hard.  This means a couple things, if you are a condo seller - be sure to price your home aggressively.  The best condo at the best price is the one that will sell.  For the buyer - you are in the driver's seat.  There is almost a year of inventory currently and this is definitely working in your favor.

It is my prediction the we will peak with our inventory in the next couple months.  The decline will be dramatic as we approach the winter holiday season and bottom out in February.  Remember the real estate market is cyclical so just take a look above at the charts.  Buyer demand jumps in February - this is the time of year we have the lowest supply and highest demand.

We are definitely in a buyer's market, but that does not apply to 100% of the homes listed. There are some unique homes in very desirable locations that do not conform to these charts.
